1. Who we are and who is responsible for data processing

a) Corporate structure and group of companies

Blue Tomato GmbH, FN 80499g (hereinafter referred to as Blue Tomato Austria) is an Austrian company based in Hochstraße 628, 8970 Schladming and part of the Zumiez Group, with the parent company Zumiez International, LLC based in Lynnwood (USA) and its subsidiary Zumiez Europe Holding GmbH based in Lucerne (Switzerland). Zumiez International LLC and its subsidiaries in Europe form a group of undertakings (hereinafter referred to as Blue Tomato) within the meaning of the GDPR.
Blue Tomato Austria is the operator of the Blue Tomato website and all online presences and is operationally responsible for all subsidiaries of the Zumiez Group in Europe. The head office and main establishment within the meaning of the GDPR is located in Austria.
All companies in the Group are committed to the protection of personal data within the framework of "binding corporate rules". Further information on how to assert your rights can be found under point 6.

d) Cloudflare

We use the services of Cloudflare, Inc. (101 Townsend St., San Francisco, CA 94107, USA) on our website to optimize loading times and protect our site from attacks.

Cloudflare has full access to the data traffic between our website and its visitors. The following data, among others, is collected:

Cookie information
Website usage data

This data is typically stored for less than 24 hours and is used to detect and prevent threats as well as to improve the performance of our website.

Cloudflare processes data in the USA. According to the European Court of Justice, there is currently no adequate level of protection for data transfer to the USA. This may involve various risks for the legality and security of data processing. As a basis for data processing with recipients located in third countries, Cloudflare uses standard contractual clauses approved by the EU Commission to ensure the EU level of data protection even outside the EU.

The use of Cloudflare is based on our legitimate interests pursuant to Art. 6 (1) lit. f GDPR to make our website more secure and efficient. If explicit consent has been requested, processing is carried out solely based on Art. 6 (1) lit. a GDPR, and consent can be revoked at any time.

e) parcelLab

We use the services of parcelLab GmbH, Kapellenweg 6, 81371 Munich, Germany, to provide you with shipment tracking and delivery notifications regarding your order. For this purpose, we transmit to parcelLab the necessary information, such as your order number, tracking number, and your contact details (e.g. email address and, if applicable, telephone number).

parcelLab processes this data exclusively for the purpose of sending you updates on the status of your delivery and improving the transparency of the shipping process. Your data is not used for marketing purposes or passed on to other third parties.

The legal basis for this data processing is Art. 6 (1) lit. b GDPR (performance of contract), as providing shipping information is necessary for fulfilling your order.

f) Zendesk

We use the customer service platform Zendesk, operated by Zendesk, Inc. (989 Market Street, San Francisco, CA 94103, USA), to manage customer inquiries, communication, and support processes via email, chat, and phone.

Zendesk processes customer data on our behalf in accordance with Article 28 GDPR (processor relationship). This may include your name, contact details (such as email address or phone number), order details, and communication history related to customer support. The data is stored and processed exclusively for the purpose of handling customer service requests and improving our service quality.

Zendesk may process data in data centers located within the European Union, as well as in the United States. In cases where data is transferred to third countries outside the EU, Zendesk ensures compliance with EU data protection standards through the use of EU Standard Contractual Clauses (SCCs) approved by the European Commission.

The legal basis for data processing through Zendesk is our legitimate interest pursuant to Art. 6 (1) lit. f GDPR, which is to provide efficient and high-quality customer support. If your inquiry relates to the performance of a contract or pre-contractual measures, the legal basis is Art. 6 (1) lit. b GDPR.

g) Hello Charles

We use the messaging and marketing platform Hello Charles, operated by Charles GmbH (Gartenstraße 86–87, 10115 Berlin, Germany), to inform you via WhatsApp about the latest news, trends, and promotions.

Hello Charles processes your personal data on our behalf in accordance with Article 28 GDPR (data processing agreement). This includes, in particular, the data you provide as part of the WhatsApp communication, such as your name, phone number, messenger ID, profile picture, chat history, and message content. The processing is carried out exclusively for the purpose of managing and conducting messenger communications and optimizing our marketing communication through this channel.

Hello Charles uses the WhatsApp Business API for technical delivery. This integration ensures that WhatsApp itself has no access to the communication content within our area of responsibility. The controller for WhatsApp is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. The use of WhatsApp is subject to the WhatsApp Privacy Policy. According to the business terms, WhatsApp collects, stores and uses information outside the EU (e.g. in the USA and other countries worldwide).

Your consent to the use of WhatsApp constitutes the legal basis for the processing of personal data collected through the use of WhatsApp pursuant to Art. 6 (1) lit. a GDPR (consent). The legal basis for data processing via Hello Charles is our legitimate interest pursuant to Art. 6 (1) (f) GDPR, which you grant by actively registering and confirming your subscription via WhatsApp. You can withdraw your consent at any time with effect for the future.

h) Trustpilot

We use the rating platform Trustpilot, operated by Trustpilot A/S (Pilestræde 58, 1112 Copenhagen, Denmark), to invite customers to submit feedback after a purchase. For this purpose, we share your name, email address, and order reference number with Trustpilot so that an invitation to review your purchase can be sent.

The legal basis for this is our legitimate interest in obtaining authentic customer feedback and improving our services (Art. 6(1)(f) GDPR). Trustpilot acts as a data processor on our behalf in accordance with Art. 28 GDPR. 2. Scope of the privacy statement

This privacy statement applies to the Blue Tomato Group within Europe, to all Blue Tomato Austria websites and all our other online appearances, including social media sites and in particular the Facebook fan page.

3. What data does Blue Tomato process and how is it collected?

a) How does Blue Tomato collect personal data?

We either collect the data ourselves, e.g. through your entry on our website, announcements in the store etc., or we obtain it from a third party, e.g. through an order at trading platforms. Furthermore, we may also process data that we obtain from publicly available sources.

b) What data does Blue Tomato process?

In compliance with data minimisation, Blue Tomato only processes data that is required for the performance of the contract, the fulfilment of legal obligations or within the scope of our legitimate interests, or if you have expressly agreed to this. Wherever possible, Blue Tomato (pseudo)-anonymises your data. You can read more on the subject under point 12, Security measures. Blue Tomato does not process any special categories of customer data as laid out in Art. 9 GDPR.

The personal data processed by Blue Tomato includes:

personal data such as name, address, birthday, place of birth and delivery address,
physical data such as weight, height, shoe size, clothing size, but only to the extent that it will not be possible to identify you personally,
contact details such as telephone number, email address,
data and information from electronic data interchange, such as IP addresses, cookies, pixels, apps, etc;
order data from purchase orders,
advertising and sales data,
general communication data, such as inquiries and consultations via Customer Service,
data which Blue Tomato collects itself or through its partners, such as purchasing behaviour, payment behaviour and interests,
data for the fulfilment of legal and official obligations,
data for the fulfilment of contractual obligations such as warranties or guarantees,
credit card data, which is masked before processing and used only within the context of abuse control,
other account data, only for bank deposits and (return) transfers.

4. For what purpose do we process data and what is our legal basis (justification) for doing so?

Blue Tomato wants to offer you an optimum product range and the best possible selection of products and services, specifically tailored to your preferences and interests. We must also take into account country-specific circumstances such as language, currency and, if necessary, different regulations.

We process data on the basis of the above-cited legal grounds and the purposes associated with them.

a) For the fulfilment of (pre)contractual obligations (Art. 6 (1) lit b GDPR)

b) For safeguarding the legitimate interests of Blue Tomato or a third party (Art. 6 (1) lit f)

We collect, store, process and analyse the data mentioned above in order to enhance your shopping experience in our web shop and stores and to offer you the best advice and services such as travel, sports courses, contests and other events as well as the option to participate in all Blue World offers, and also to inform you about products, trends, innovations and services.

Legitimate interests of Blue Tomato or a third party are:

the execution of marketing activities, in particular personalised advertising in cooperation with third parties, e.g. advertising partners,

the implementation of loyalty programs for customers,

the provision of a customer account and customer profile on Blue Tomato's websites

the processing and storage of communication contents from emails, phone calls or other communication means (e.g. in the event of complaints, requests for information in accordance with point 6),

the dispatch of your order by order processors, in particular carriers who may also receive your email address and telephone number for delivery and tracking purposes,

maintaining the functionality of our website, our online shops and other Blue Tomato online media,

the analysis of purchasing behaviour by Blue Tomato and advertising partners,

the implementation of monitoring measures to protect employees, customers and the property of Blue Tomato, suppliers and other partners,

the enforcement of legal claims and defence against unjustified claims,

measures to combat and prevent fraud, e.g. credit card fraud,

consultation of credit agencies and data exchange for credit checks,

the implementation of measures for the further development of the product and service range,

statistical evaluations

coordination, business development and strategic measures within the Blue Tomato Group.

According to Art. 21 GDPR, in individual cases it is possible to object to data processing on the basis of legitimate interests. You can find out more about this under point 6.

c) Within the scope of your consent (Art. 6 (1) lit a)

Apart from points a) and b), Blue Tomato only processes your personal data after you have given us your consent, e.g. for sending newsletters or using cookies (more on this under point 10, Cookies policy). Your consent can be revoked at any time. Please also refer to point 6 in this respect.

5. Who receives your data?

a) General provisions

Blue Tomato has clear rules on who may receive personal data. Within the Blue Tomato Group, your data is made available only to those departments and employees who require it to fulfil contractual, legal and supervisory tasks and obligations and to safeguard the legitimate interests listed under point 3 b).
Furthermore, your data is also made available to processors commissioned by Blue Tomato, i.e. companies that support us in fulfilling our corporate goals and tasks, such as IT companies, payment providers, suppliers, deliverers, printers, address validation partners (we work with Loqate) to the extent necessary to perform the tasks assigned to them. Blue Tomato concludes written agreements with these processors which oblige them to comply with the same requirements that apply to Blue Tomato.
In addition, Blue Tomato also makes personal data available to third parties with whom Blue Tomato cooperates within the scope of the aforementioned processing purposes or who may have a legitimate interest within the scope of the cooperation, e.g. debt collection agencies, payment providers or trading platforms, if you purchase from Blue Tomato via these platforms.
If there is a legal or official obligation, public authorities may also receive data from us.

b) Data transfer to third countries

Data will only be transferred to countries outside the EU if the country has an adequate level of protection according to Art. 45 GDPR or if other safeguards according to Art. 46 GDPR appropriately protect your data.
Blue Tomato has drawn up binding corporate rules within the Group, which must be approved by the data protection authorities in accordance with Art. 46 (2) lit b, in addition to the standard data protection clauses pursuant to Art. 46 (2) lit c. Blue Tomato transmits data on the basis of these safeguards.

c) Other data transmission to the USA

For the sake of completeness, we would like to point out that in the USA the surveillance measures of US authorities allow the general storage of all personal data of all persons whose data has been transmitted from the EU or Switzerland to the USA. This is done without differentiation, restriction or exception with respect to the aim pursued and without an objective criterion that would make it possible to restrict the US authorities' access to data and its subsequent use to very specific, strictly limited purposes which justify the interference associated with both access to, and use, of such data. Furthermore, we would like to point out that, in the USA, there are no legal remedies available to data subjects which would allow them to gain access to the data concerning them and to obtain its correction or deletion, and that there is no effective legal protection against general access rights by US authorities. We explicitly draw your attention to this legal and factual situation so that you can make an informed decision when you agree to the use of your data.
We would also like to expressly point out that the USA and in particular companies outside the "EU-U.S. and Swiss-U.S. Privacy Shield Framework" do not provide an adequate level of data protection.

6. For how long do we process and store data?

We retain your data for the duration of the business relationship and in order to carry out advertising activities within the framework of legitimate interests, for as long as you do not exercise your right to object to this processing according to Art 21 GDPR or, where you have given us your consent, if you do not revoke it. For more information, refer to point 6.
Longer retention periods may be required due to legal storage and documentation obligations. In particular, this refers to the Austrian Federal Fiscal Code (BAO) and the Business Code (UGB) as well as other national and European legal requirements.
Due to our warranty obligations and the guarantees of our suppliers, or on the basis of statutory regulations, retention periods of 3 years (short period of limitation) or, in individual cases, also considerably longer retention periods (long period of limitation) may be necessary.

7. Your rights as data subject.

The GDPR grants you comprehensive protection and information rights and particularly the right to object and withdraw. You can contact our data protection officer with your request or complaint at any time.
The supervisory authority responsible for the Group is the Austrian data protection authority. They can also be contacted in the event of a complaint. www.dsb.gv.at
Your rights, which you can normally exercise free of charge, in detail:

a) Right to be informed according to Art. 15 GDPR

You have the right to obtain information free of charge concerning the personal data stored about you and, if necessary, the right to correct, block or delete it, and to withdraw given consents. Please contact our data protection officer if you would like to know how your data is used.

b) Right to rectification according to Art. 16 GDPR

e) Right to object in accordance with Art. 21 GDPR and to withdraw consent in accordance with Art. 13 GDPR

If the processing of your data is based on your consent according to Art. 6 (1) lit a, you can withdraw this consent at any time.
If we process your data on the basis of our legitimate interests, you can object to such processing in accordance with Art. 21 GDPR. We will then immediately check whether your request is justified.
To exercise your right to withdraw and object, simply contact our Customer Service or the Data Protection Officer.

f) Automated individual decision-making, including profiling, in accordance with Art. 22 GDPR

You have the right not to be subject to a decision based on automated processing and profiling if this has legal effect or significantly affects you in a similar manner.

Blue Tomato uses automated decision making and profiling according to point 9.

8. Ali nam morate poslati podatke?

Za obdelavo vašega naročila potrebujemo vaše podatke. Če nam posredujete podatke, ste dolžni zagotoviti resnične podatke. Če se odločite, da boste v postopku naročanja uporabljali način plačila »Nakup z računom«, vas bomo prosili za soglasje za posredovanje zahtevanih podatkov zadevnemu ponudniku plačila za obdelavo plačila ter za preverjanje identitete in kredibilnosti. Če podate soglasje, bodo vaši podatki (ime in priimek, ulica, hišna številka, poštna številka, mesto, datum rojstva, telefonska številka) in podatki, povezani z vašim naročilom, posredovani zadevnemu ponudniku plačila. Za namene preverjanja vaše identitete in kredibilnosti posreduje zadevni ponudnik plačila ali partner podjetja, ki ga pooblasti ponudnik plačila, podatke bonitetnim agencijam in od njih prejme informacije med drugim tudi informacije o vaši kredibilnosti na podlagi matematično-statističnih postopkov, izračuni katerih med drugim vsebujejo podatke o naslovu. Poleg tega ponudnik plačila za odkrivanje in preprečevanje goljufij vključi pomoč tretjih oseb. Podatke, pridobljene na ta način, je mogoče po potrebi pri tretjih osebah shraniti šifrirano tako, da jih lahko prebere samo zadevni ponudnik plačila. Samo, če izberete način plačila "Nakup z računom" našega partnerja za sodelovanje, bodo ti podatki uporabljeni, sicer podatki samodejno zapadejo po 30 minutah.

b) Določanje profila

Blue Tomato poskuša upoštevati vaše osebne interese, želje in vedenje kupcev, da bi vam zagotovili optimalno izkušnjo nakupovanja v naši spletni trgovini in v trgovinah. V ta namen analiziramo tudi podatke, ki ste jih navedli vi, vaše vedenje ob nakupovanju in brskanju v okviru zakonskih določb. Kolikor bomo uporabili piškote in slikovne pike, vas bomo v okviru naše Direktive o piškotkih zaprosili za vaše soglasje, če uporaba ni potrebna za komunikacijo ali če je zakonit interes podjetja Blue Tomato dovoljen brez vašega soglasja. 10. Direktiva o piškotkih, analize spletih mest, družbeni mediji in oglaševanje po e-pošti

a) Splošne informacije o uporabi piškotkov

Na različnih straneh uporabljamo piškotke in slikovne pike, da obisk naše spletne strani naredimo privlačnega in omogočamo uporabo določenih funkcij. Pri tem gre za majhne besedilne ali slikovne datoteke, ki se shranijo na vaš računalniku ali so vključeni v naše spletne strani. Ti pomagajo pri prepoznavanju vedenja brskanja in s tem je mogoče vaše dele spletne strani ali določene informacij prilagoditi vašim interesom. Blue Tomato pri tem uporablja »Piškotke prve strani« in »Piškotke tretje strani«. »Piškotek prve strani« prihaja iz podjetja Blue Tomato kot lastnika spletne strani samega. Piškotki tretje strani se nanašajo na drugo, »tretjo« osebo (ponudnik storitev spletnega trženja itd.), ki svoje spletne piškotke namesti na našo spletno stran na podlagi pogodbenega sporazuma. S piškotkom prve strani vas lahko kot uporabnika prepoznajo samo tisti strani, pod koder izvira piškotek, vendar ne prek več domen. Podatki se torej s tem ne posredujejo tretjim osebam.
Piškotke tretjih strani nastavijo pogodbeni partnerji, ki na podlagi pogodbenega razmerja s podjetjem Bule Tomato zbirajo uporabniške podatke, da optimizirajo in/ali prilagodijo trženjske dejavnosti.

To so tisti, ki so nujni za vzdrževanje komunikacije, potrebnih funkcij in/ali zagotavljanje informacij. Ti se nastavijo samodejno in ponovno izbrišejo po koncu seje brskalnika ali poteka določenega časa.

To so tisti, ki ostanejo na vašem računalniku za predvideni čas in zagotovijo, da Blue Tomato prepozna vaš računalnik ob naslednjem obisku strani in nastavitve ter informacije, pri čemer vam prihrani, da ponovno izpolnite obrazce s svojimi podatki. V nadaljevanju vam predstavljamo celovit opis vseh piškotkov/slikovnih pik, ki jih uporablja Blue Tomato, ki se uporabljajo za osebne podatke.

c) Možnosti preklica in ugovora

Izdano soglasje lahko kadar koli prekličete in ugovarjate tudi v zvezi s tistimi piškotki/slikovnimi pikami, ki ne zahtevajo soglasja za uporabo, če ti niso nujni oz. je deaktiviranje tehnično izvedljivo. Vendar pa opozarjamo, da v primeru ugovora ni mogoče zagotoviti vseh funkcij spletne strani v njihovem polnem obsegu.

Imate več možnosti, da nasprotujete uporabi piškotkov/slikovnih pik ali prekličete že izdano soglasje.
Tako najobičajnejši brskalniki ponujajo možnost, da preprečijo uporabo piškotkov. Pod naslednjimi povezavami se boste naučili, kako deluje:

O razširitvah brskalnika, na primer Ghostery lahko sami onemogočite in upravljate posamezne piškotke, kateri piškotki se nastavijo in kateri ne. Namestitev je preprosta, hitra in na voljo za vse običajne brskalnike.
V primeru "piškotov tretjih strani" vključeni ponudniki storitev pogosto ponujajo možnosti za deaktiviranje. Najpomembnejši so prikazani v točki d).
Poleg tega vam Blue Tomato ponuja pri vsaki novi seji omogoči, da se za vsako privolite ali onemogočite uporabo pasice za piškotke.

d) Spletna analitika in družbeni mediji

GOOGLE ANALYTICS

Google Analytics je storitev Google Inc., 1600 Amphitheater Parkway, Mountain View, CA 94043, ZDA ("Google"). Google Analytics uporablja "piškotke", ki so besedilne datoteke, shranjene v računalniku, in omogočajo analizo Googlove uporabe ponudbe Blue Tomato. Podatke, ki jih piškotek zbira o uporabi naših spletnih strani (vključno z vašim naslovom IP), se običajno posredujejo Googlu in shranijo na strežnike v ZDA. Blue Tomato opozarja, da je na spletnih straneh Blue Tomato Google Analytics razširjena s kodo "gat._anonymizeIp () ;;", da bi zagotovili anonimno zbiranje IP-naslovov (tako imenovano IP-maskiranje). e) E-poštno oglaševanje

Če se naročite na novice, se vaš e-poštni naslov uporablja za vaše oglaševalske namene, dokler ne odjavite prejemanja novic. 11. Naši varnostni ukrepi

Vaši osebni podatki bodo v postopku naročanja prek »Secure Socket Layer« (SSL), preneseni šifrirano (pri tem je izključen prenos naslova pri naročnini na novice). Pri vseh postopkih obdelave upoštevamo načela SUVP v skladu s 5. členom in v okviru našega sistema za varstvo podatkov izvedemo temeljit pregled vseh postopkov obdelave. Poleg tega izvajamo redne zunanje revizije varstva podatkov.
Dostop do vašega uporabniškega računa je možen samo po vnosu vašega osebnega gesla. Informacije o dostopu morate vedno obravnavati zaupno in zapreti okno brskalnika, ko končate komunikacijo z nami, še posebej, če uporabljate računalnik skupaj z drugimi.
